The Section 53 Mineral and Petroleum Resources Development Act approval granted to the Springbok Solar power plant has been formally revoked.

This follows a previously announced dispute arising with gas producer Tetra4 about the solar plant development encroaching on its production right.

Tetra4 is a subsidiary of natural gas and helium producer Renergen.

The Springbok Solar plant is owned by independent power producer SOLA Group.

Department of Mineral Resources and Energy (DMRE) director-general Jacob Mbele this week ruled in favour of Tetra4, upholding Tetra4’s appeal against a DMRE regional manager’s decision concerning land use rights.

Mbele found procedural defects in the approval process by the regional manager, specifically, that Springbok failed to consult Tetra4 as required under regulations.

Springbok Solar has received the decision and is currently considering the next steps, SOLA Group assets MD Katherine Persson said in response to questions from Engineering News

She explained that the department's decision directed the parties to consult further and to provide feedback to the regional manager within 30 days. As such, Springbok Solar will consult with Tetra4 over the next 30 days as directed and report back to DMRE with the results of the consultation.
